I write as attorney for Palm Inc. ("PALM").

As you are, no doubt, aware, PALM owns all of the rights to the intellectual property of the Be Operating System,

We have recently learned that you have been brandishing various elements of PALM properties on your site at beosjournal.org, including use of the trademarked logo, word 'Be', and connotations to the effect of using the intellectual properties owned by PALM in a familiar manner without paying required licensing fees.

Your posting and usage of said items is an infringement of PALM's rights in their Properties.

Based upon the foregoing, we hereby demand that you confirm to us in writing within ten days of receipt of this letter that:

(i) you have removed all infringing materials from your site, including the aforementioned items and all related imagery and documentation;

(ii) you will refrain from posting any similar infringing material on the Internet or any other on-line service in the future.

The foregoing is without waiver of any and all rights of PALM, all of which are expressly reserved herein.

Well guys...I don't know what to say... I put this off as long as I could, for months, but I received this last week from Palm, and have been trying to think of a way around it. I've contacted a lawyer, and am looking into an appeal. I still have a few days left, but I don't know if I should hold out till the last minute or not.

If anyone has ideas, please .
